Expressing annoyance over the failure of police in submitting the charge sheet against former military ruler Pervez Musharraf in judges’ detention case, special Anti Terrorism Court (ATC) Saturday directed them to present the complete challan of the case on the next date of hearing.
The ATC judge Syed Kausar Abbas Zaidi resumed the hearing of the case based on the First Information Report (FIR) registered with the Secretariat Police Station on Aug 11, 2009. The FIR was registered on the complaint of Advocate Ghumman who sought legal proceedings against the former military ruler for confining 60 judges of the superior courts.
During the hearing, Investigation Officer (IO) Inspector Mubarik appeared before the court and requested the judge to grant him some more days to complete the charge sheet. On this juncture, the ATC judge expressed his displeasure and remarked that police had failed so far to furnish interim challan of the case. Counsel Ilyas Siddiqui representing Pervez Musharraf appeared before the court and argued that despite lapse of 45 days, police had not submitted the challan while as per law they should submit it within 15 days.
He requested the court to direct the police for submitting the challan as soon as possible. On this, public prosecutor Aamir Nadeem Tabish informed the court that notification regarding his appointment as prosecutor was delayed but he assured the court that charge sheet against Musharraf would be submitted on the next hearing of the case. He also informed the court that the IO of the case had written letters to the concerned institutions to complete the charge sheet but no reply was received from them. Later, the court directed them to submit the challan on the next date of hearing and deferred the hearing till June 6 for further proceedings. It is pertinent to mention here that the ATC had already turned down Musharraf’s bail plea in judge’s detention case while now, he has approached the Islamabad High Court (IHC) to obtain bail in the case.
