LAHORE - A full bench of the Supreme Court (SC) here Tuesday acquitted two death convicts in the murder case of Additional Secretary Health Punjab AR Sharif which took place at the office of a carpet-weaving firm in the jurisdiction of Naulakha Police Station on Nov 23, 1999. The bench headed by Justice Tassadduq Hussain Jillani and comprising Justice Muhammad Akhtar Shabbir and Justice Ghulam Rabbani acquitted Zulfiqar Hussain and Shahid Javed convincing with the arguments made for them by senior advocate Khawaja Sultan Ahmad. Sharif was killed at the carpet office of his son where the appellants were employees. The FIR was got registered by brother-in-law of the deceased against the unknown persons. Later on, the appellants were taken into custody on the murder accusations of Sharif on basis of a witness and another employee Naseer Ahmad. He claimed the accused got Sharif tied up at the upper floor, adding that he saw his master under fire shots at the hand of the appellants when he freed himself by cutting the ropes. The complainant side contested the appeals through Sardar Khurram Latif Khosa advocate who contended that the appellants along with another Khursheed Ahmad, who was killed by their misdirected fire-shots, had committed a cold-blooded murder of Sharif out of sectarian grudge as the deceased was a Qadiani. The appellants counsel Khawaja Sultan Ahmad argued that it was a blind murder which did not carry any tincture of sectarianism. He said Naseer Ahmad was also a Qadiani and if it was sectarian killing, the appellants would also not have spared him. He said Naseer says he informed the complainant about the murder of his master but latter did not name anybody in the FIR which was not possible had Naseer actually seen the occurrence in which eventuality he would also have told the complainant who were the killers. Naseer, he said, was the sole witness but a number of contradictions existed in his statement about time of the occurrence and his position on the spot etc. The counsel said no body knows what actually had happened but that Khursheed deceased and Sharif previously has some tension over which they shot fire on each others. He said post-mortem of the deceased was carried out with two days delay while empties recovered from the spot were also sent to the laboratory after 15 days of the occurrence. The IO of the case, he said, also deposed that Naseer was not present on the spot. The court after hearing the arguments and perusal of the record allowed the appeals and acquitted the death convicts.
