Islamabad - The Islamabad High Court will today (Monday) take up an application praying the court for issuance of its detailed judgement in a matter challenging the absorption and appointment of civil judges from provinces in the lower judiciary of Islamabad.

A single bench of IHC comprising Justice Aamer Farooq will conduct the hearing of the petition while Waqas Malik Advocate, secretary general Islamabad bar, will represent the lawyers from the federal capital.

This matter is related to a resolution of the DBA dated July 2012 when DBA had passed the resolution against the alleged unlawful appointments/absorption of the judges in the sessions courts of Islamabad.

Then, Syed Javed Akbar Advocate in his capacity as DBA president and then President IHCBA Syed Nayyab Hassan Gardezi had filed petitions on the basis of aforementioned resolution against the appointments of civil judges citing these illegal and against the law. 

Through a short order in November 2012, Justice Shaukat Aziz Siddiqui had declared the said appointments/absorption illegal and had directed the IHC registrar to send back those judges of the lower courts who have been appointed in violation of the rules.

However the detailed judgement in this matter remained pending and could not be issued till now.

Due to the reason, judges in the lower judiciary could not be sent back. Later, a lawyer requested the court to issue detailed judgment in the said matter in July 2013.
