Supreme Court Tuesday constituted a one-man Judicial Commission to probe the Lal Masjid incident.
A three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry heard the proceedings of the petition filed against Lal Masjid tragedy.
The Supreme Court appointed senior judge of the Federal Shariat Court Shahzad-ul-Sheikh to conduct the investigation and submit a report within 45 days.
The bench of the apex court stated that Judicial Commission will probe into the reasons of Lal Masjid incident, how many people including men, women and from law enforcement agencies were killed, whether the state has paid the compensation to the heirs of killed people, whether the dead bodies were identified and handed over to their heirs, whether the action has been taken against the people who are responsible for the tragedy, whether the people who are responsible for the tragedy could be marked with the available evidences and facts.
During the hearing, SSP Islamabad Police Tahir Alam submitted a report pertaining to the operation in the court. Tahir Alam told SC that no dead body of a woman nor girl were obtained from Lal Masjid.
Following the development, Chief Justice Iftikhar Muhammad Chaudhry remarked while addressing Tahir Alam that this report is not correct as innocent girls were also killed during the Lal Masjid operation.
Tahir Alam said that he is putting facts before the bench in the lights of report. He said that people of Lal Masjid violated the law and took weapons against the personnel of law enforcement agencies.
“We ordered people to leave Lal Masjid but they violated our orders”, Tahir Alam said.
The Chief Justice remarked, “You had accomplished operation and now you are investigating the matter and presenting explanations”.
Then, the SC decided to conduct un-biased judicial inquiry of the incident by ordering constitution of a one-man Judicial Commission and appointed senior judge of the Federal Shariat Court Shahzad-ul-Sheikh to conduct the investigation and submit a report within 45 days.
The case subsequently adjourned for 45 days.
