PRESIDENT Supreme Court Bar Association Barrister Aitzaz Ahsan has said that the judges cannot be reinstated by the constitutional package because the govt does not enjoy two-thirds majority in the Senate. Speaking in Waqt News TV's programme 'Barwaqt' on Tuesday, he said that the matter of reinstatement of judges was quite simple but it had been made complicated. He said that some points of the constitutional package were, however, good but the judges should be reinstated unconditionally. He opined that the judges could have been reinstated within ten minutes time, had Prime Minister Yousuf Raza Gilani ordered their instatement at the same time when he had ordered their release. Aitzaz said that the there was no consensus in the PPP over the reinstatement of the judges but he could not doubt any body's intention. He said that Sharifuddin Pirzada and Attorney General Malik Abdul Qayyum were the advisor of November 2 ex of the president and it was an ill-luck that they were still in their offices. He said that the Prime Minister could term them out if he wished. Answering a question Aitzaz said that Murree Declaration was a very clear document. He also said that there was no justification of terminating 60 judges at a time if the president scared just one judge. "This is bad luck with us that the judiciary had been subdued for 60 years and when Justice Iftikhar Ch tried to get it liberated and he was dismissed. In reply to another question, he said that BB wanted Justice Iftikhar Ch to continue as Chief Justice. He added that he was not going against the policies of his party and he had consulted Benazir before contesting Supreme Court bar election. "I have always been in the PPP and I will continue to be in it". Talking about the lawyers fraterniy he said the lawyers would never come under American or any other pressure. The lawyers had given a number of sacrifices for the independence of the judiciary and thousands of the lawyers from the US and UK were joining hands lawyers movement in Pakistan, he claimed.
