ISLAMABAD - The Supreme Court on Friday, hearing case of killing of 12-year-old boy in a wedding party in Faisalabad, referred the matter of additional session judge, who had granted bail to the accused in violation of law, to the Chief Justice Lahore High Court and ordered the Chief Secretary Punjab, to take action against the CPO of metropolitan. Chief Justice said no one is above the law, adding the Additional Session Judge, Faisalabad, cancelled the bail when the apex court took notice of the illegality. A two-member bench headed by Chief Justice Iftikhar Muhammad Chaudhry and comprised Justice Khilji Arif Hussain heard a suo moto case. The court declaring Faisalabad CPO Rai Tahir ineligible directed the Chief Secretary Punjab to transfer and take action against him. The chief justice said that the excuse presented before the bench is not acceptable as being the head of the police department of Faisalabad either that was negligence that he has no knowledge of the compromise or intentionally got the matter lingered on. Such police officer is not competent to control the crime therefore should be posted to some other place, the CJP said. The CPO earlier pleaded that he had no knowledge of the compromise and the accused could not be arrested earlier as he hid himself. Therefore the police had arrested his brother. The court noted that CPO failed to curb the crime in its jurisdiction by showing complete negligence. The FIR was lodged on 1st September 2009, the same day of the crime, but the accused was not arrested until September 22, 2009. An MPA of Punjab Assembly belonging to Pakistan Muslim League-Nawaz Khawaja Islam has pressurized the boys family for compromise. The Chief Justice said the Rs0.6 million was paid to boys parents is not in accordance with Diyat amount, fixed by the federal government. Attorney General Maulvi Anwar-ul-Haq informed the court that according to Section 323 of Pakistan Penal Code (PPC) the Diyat is one of the punishment and its minimum amount is equal to 31,630 gms, that is fixed by the federal government. The court could enhance Diyat amount keeping in view the financial position of the murderer. The chief justice said the purpose of punishment is to serve as the deterrent against the crime. The CJP said: Its written in Surah Almaida that murder of a man is the murder of all human beings. The chief justice inquired from the attorney general whether the compensation amount should be of that time when offence was committed or it should when the compromised finalized between the parties? The AG responded that if the complainant forgives the murderer in Badl-e-Sulah then the amount should be paid as given in the Sec 323 PPC. The hearing is adjourned till November 18, 2011.
