MUZAFFARABAD (APP) - The AJK Law Ministry is reluctant to implement President Raja Zulqarnains directives of withdrawing the reference against the dysfunctional Chief Justice Riaz Akhter Chaudhry, which has been forwarded earlier by the acting president Shah Ghulam Qadir on the advice of Prime Minister Raja Farooq Haider. Talking to APP, Secretary Law Raja Abbas Monday said President Zulqarnain had issued an order to him stating that the reference was filed hurriedly in his absence by the acting president; therefore, it was being withdrawn and notification was being issued for the reinstatement of the deposed CJ. According to the secretary, the presidential directive had no legal ground, as he was bound to act upon the advice of the prime minister, as stated in Section 7 of the AJK Interim Constitution. He was the view that THE acting president could exercise all powers of the president in his absence and the reference was filed on the advice of prime minister, which was mandatory for the president to act upon. Once the reference had been filed, even the prime minister could not advice to withdraw it, Abbas contented. He clarified that only the Supreme Judicial Council could reinstate the dysfunctional CJ after hearing the reference. Meanwhile, Acting Chief Justice AJK Manzoor Hussain Gilani has closed Mirpur Registry of the apex court and directed the staff to report at Muzaffarabad.
