IHC stays extradition of Pakistani national to Dubai

ISLAMABAD-The Islamabad High Court (IHC) Friday issued stay orders against the extradition of a Pakistani citizen Fareed Aman Ullah Khan allegedly involved in a murder case to Dubai. 
A single bench of IHC comprising Justice Aamer Farooq conducted hearing of the petition filed by Farid who approached the court through his counsel Shah Khawar Advocate against his extradition to Dubai. 
The IHC bench also issued notices to Secretary Ministry of Interior, district magistrate Islamabad and additional deputy commissioner and directed the respondents to submit their response in this matter till April 2. 
In his petition, he stated that he was arrested on a note verbale/ request of extradition dated on 29 August, 2017 by the authorities of Government of Dubai and is presently confined in central jail Adiala.  He informed the court that as per extradition request, the allegations leveled are that a crime report was registered in Dubai regarding the murder of a Pakistani national Muhammad Tariq while the petitioner along with his real brother Inam Ullah were nominated as accused persons for the murder of the said person. 
The petitioner continued that according to the version of prosecution, the alleged murder was committed by the petitioner and his brother Inam in revenge of marrying their sister by deceased Tariq without consent of the petitioner family. 
Fareed also said that through the request of extradition, the petitioner has been requested to be extradited to Dubai for the execution of death sentence awarded to the petitioner in absentia. 
He contended the request of Dubai Government to extradite the petitioner is illegal, unconstitutional and against the fundamental rights of the petitioner guaranteed by the Constitution of Pakistan.
Therefore, he prayed to the court to declare the request of extradition made by Dubai Government is in violation of the provisions of Constitution and law of Pakistan. He also requested the court to quash the proceedings carried out and continued by the district magistrate Islamabad on the directions of Ministry of interior. 
He also requested the court to declare the proceedings are illegal, null and void and ultra vires of the Constitution and the petitioner may be released and the order passed by the District Magistrate regarding his arrest may be declared as illegal.
