LAHORE - Through a writ petition the Lahore High Court has been prayed for disqualifying Punjab Chief Minister Shahbaz Sharif allegedly for breaching public trust (ghariameen), and causing financial loss to the public exchequer allegedly by awarding contracts of beautification work in the city to an unregistered company. The petition filed by Mian Javed Iqbal Arian, came up for preliminary proceedings before Justice Sheikh Azmat Saeed Friday when he directed the petitioner to file two separate petitions as he had questioned two different issues in the same, which merit separate considerations. The petitioner has alleged that contracts of beatification plan for city awarded to M/s Al-Imam Enterprises when, he added, Lahore development authority was fully competent and capable with all infrastructure and technical expertise to perform this job. The petitioner alleged that the said contract was awarded to Al-Imam enterprises through LDA at the behest of chief minister in violation of Punjab Procurement Rules 2009 and all other rules and regulations. The company had been asked to devise plans for the beautification of Shalimar interchange and underpasses, CBD Gulberg area, park and ride plaza, rail transit line, detail urban design works for interim policy for 58 notified roads of Lahore within the jurisdiction of LDA and landscaping of green belt alongside UBD Canal, Shalamar underpasses, Lahore. He further said that Project Management Units established by director general LDA for supervision and to oversee the work being done or to be done, but it was functioning without any authority and competence under the law. The members of these units were being paid from the public funds and that also illegally, he added. Mian Shahbaz Sharif, chief minister, has made himself a violator of the constitution and liable to be declared guilty of breach of trust, therefore, not fit for holding a public office, petitioner argued. He requested the court that the act of engaging the respondent company as consultant to fetch detailed architectural, engineering and urban design work for the project of urban regeneration of Gulberg area residential district in general and MM Alam Road in particular, be declared illegal. And payment made to the company in this regard be recovered.
