LAHORE - The Lahore High Court Chief Justice on Tuesday reconstituted a division bench to hear the writ petition and appeals filed earlier by Sohail Zia Butt against his conviction in absentia in a reference by an accountability Court in 2001. The bench comprising Justice Ch Ijaz Ahmad and Justice Ahmad Farooq Sheikh will take up hearing in Zias pleas on Monday October 11, next. Earlier on September 30, it came up for hearing before a bench comprising Justice Chaudhry Iftikhar Hussain Chaudhry and Justice Syed Mazahar Ali Akbar Naqvi and the bench refused to hear the case and referred it to CJ for fixing it before any other bench. An accountability court had sentenced Butt to three-year in jail in absentia in a bank default case in 2001. In execution of arrest warrants issued by NAB in January 12, 2001 the accused was arrested after nine years of his conviction from near Kalma Chowk on September 1. He filed an appeal against his conviction and a bail application. The bench had already condoned the delay of about nine years, which earlier hindered Sohail Zia from moving to the appellate court against him conviction, under the law of limitation. The reference against Subail Zia was filed during the regime of Gen (r) Pervez Musharraf accusing him of 'embezzling Rs2 million which he allegedly received from National Industrial Finance Corporation (NIFC) under a deal to get Ahmad Mansion, The Mall, evacuated from the illegal occupants which he failed to honour. On the complaint of the executive officer of the corporation, the reference was framed against Butt by the NAB. Advocate Ehtasham Qadir is appearing for the appellant.
