Disqualification case, PTI senator seeks court directions to bar ECP from proceeding against him

ISLAMABAD - The Islamabad High Court (IHC) Monday adjourned hearing in an Intra-Court Appeal (ICA) of Senator Faisal Vawda seeking directions to bar the Election Commission of Pakistan (ECP) from proceeding against him in the disqualification case. 

A division bench of the IHC comprising Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb conducted hearing of the appeal of Senator Vawda and deferred the hearing due to non-availability of the petitioner’s counsel.

During the hearing, Nauman Paracha Advocate appeared before the court and sought deferment due to non-availability of Vawda’s counsel Husnain Ali Chauhan. 

At this, Justice Aamer enquired from him that when the Election Commission of Pakistan (ECP) would take up this matter. Paracha said that he did not know anything about the case. 

Justice Aamer remarked that then, you should not say before the ECP that the matter is pending before the high court and adjourned the hearing till December 9. 

In his ICA, Senator Vawda challenged the October 12 decision by which the ECP had rejected his plea for halting proceedings against him in the disqualification case. The Pakistan Tehrik-e-Insaf Senator contended that the case against him in ECP had become invalid, as the body had failed to take a decision within the prescribed time limit. He said that the single-member IHC bench comprising the Chief Justice Athar did not consider the facts described in his plea for similar relief.
