LAHORE - Justice Sajjad Ali Shah of the Lahore High Court, taking serious notice of not arresting two police officials involved in illegal detention of a citizen, admonished a police official and remarked that the police wanted to prolong the case against its colleagues. The judge remarked this on Monday while hearing a habeas corpus petition filed by Salman Haider seeking recovery of his cousin Afzal Hussain. The judge commented it was a cognisable offence but not a single accused had been arrested in the case. The judge, however, further gave time to the police for arresting the accused after completing the investigation till July 14. Salman through his counsels Muzahir Ali Akbar and Sheikh Zameer Hussain submitted that Model Town CIA staff abducted Hussain on June 2 without his involvement in any case. He said they also subjected Hussain (60) to severe physical torture. He said, as there was no FIR against Hussain, the police to implicate him in a fake case handed him over to the Sadiqabad police. He prayed that his cousin be recovered and be set at liberty. He also demanded action against the responsible police officials. At this the court deputed bailiff for Hussain's recovery who raided at the police station but as the police had shifted him to some unidentified place, the bailiff could not recover him. On next date of hearing the judge summoned Sadiqabad SHO Chaudhry Zulfiqar and CIA SP Rana Shahid to appear in person before the court on June 5. However, appearing before the court, both the police officials submitted that Lahore police had handed over the accused to them saying that he was involved in an FIR registered in their police station. They said finding that he was not wanted in that FIR, they released him. However, the police at the same time when both police officials were present in the court released Hussain who knowing about hearing of his case appeared before the court at the same time. The judge recorded Hussain's statement wherein he submitted that the police had recently released him after three days' illegal detention. He said the police severely tortured him to harass him for bribe but he was not involved in any case. He said Model Town CIA ASI Mahmood Bhatti tortured him on order of DSP Rai Zameer-ul-Hassan. Seeing injuries on Hussain's body, the court ordered medico legal, which later proved that he was physically tortured. After examining the medical report the judge ordered investigation of the case and passed direction that some SSP level officer of Lahore would investigate into the matter and report the court on next date of hearing, June 12. However on June 12 the police informed the court that an FIR against ASI Mahmood Bhatti and DSP Rai Zameer-ul-Hassan was registered at Liberty Police Station for illegally detaining and torturing Hussain. It was informed that investigation was in process and soon the responsible would be brought to the book. The judge adjourned the hearing till July 7 for further investigation. On July 7, Pervaiz Kandhari on behalf of Investigation Officer SSP Zaulfiqar Hameed appeared before the court and submitted that no arrest was made and the investigation was in process.
