KARACHI-Former Advocate General of Sindh Anwar Mansoor Khan has sent a reference of misconduct against SHC Chief Justice Mr Justice Afzal Soomro to Supreme Judicial Council and sought his immediate suspension while a Divisional Bench of SHC has suspended the orders passed on May 5 by SHC Chief Justice. In a petition, sent to the Supreme Judicial Council under Article 209 of the Constitution, Anwar Mansoor Khan said that the SHC CJ arranged transfer of a case in his court, which was being heard by another bench is completely 'malafide and illegal'. He pleaded in petition to Supreme Judicial Council for immediate suspension as he alleged that the CJ did not know the law and is mentally incapable of being or continuing to be a judge of the High Court. Talking to newsmen in Sindh High Court after sending complaint, he complained that the CJ called a case from the court of Mr Justice Qazi Khalid to his court, which he could not do under the rules. The counsel moved an application that he had lost his faith in the CJ but the CJ did not entertain the application and adjourned the case. He again took it up the case on May 5 and dismissed it which is completely illegal and against the norms of judicial conduct. In a reference to the SJC he prayed to the Council to suspend Chief Justice Muhammad Afzal Soomro from the post of SHC CJ and initiate inquiry of misconduct against him. Meanwhile, a Divisional Bench of SHC comprising Justice Azizullah M. Memon and Justice Khalid Ali Z. Qazi on Wednesday suspended the short order dated May 5, 2008, passed by CJ Muhammad Afzal Soomro against appellant Hanif Marchant till May 28, 2008. The suspension came on an appeal filed by Hanif Marchant who has challenged SHC CJ order of May 5, in which he had dismissed the application of Hanif Marchant, which was filed against order of dismissal of appeal on case in which appellant sought ratification of a notice winding up order against Tessori Trading Company. Applicant counsel Anwar Mansoor Khan accused the SHC CJ of malafidely fixing said case before him as the case was pending before company judge Justice Khalid Ali Z. Qazi, where in April 29, 2008 was fixed for hearing. He further said that SHC CJ malafidely fixed case before him and on May 5, 2008 dismissed the application of appellant and disposed off the pending application. He said that the order of CJ had shown that he had acted with pre-conceived notion. He pleaded with the court to restore the said case in its original position and set aside the CJ order of May 5. The Division Bench after preliminary hearing, suspended CJ order of May 5, 2008 till May 28, 2008 and issued notices to respondents for the said date. The bench it its order said the detailed judgment has not been recorded by the single judge yet.
