LAHORE - The Lahore High Court (LHC) on Monday observed that the rulers should realise that judiciary was now independent, and would not tolerate any violation of law. The judge said that it was courts responsibility to deliver the benefits of independent judiciary to the masses. Justice Asif Saeed Khan Khosa made these observations while hearing a case against the Coordinator and Political Secretary of the Chief Minister Punjab who had sent one Shabbir Ahmed of Vehari to jail despite the fact that he was already enjoying bail concession granted by a court of law in Multan. The judge angrily asked the DPO Vehari, Coordinator and SHO concerned try to persuade the victim by compensating him for five days he illegally spent in jail otherwise he would order registration of case against them. The case was adjourned for September 15. CMs Political Secretary Mian Tariq and the DPO appeared before the court and sought time to compensate the petitioner. The judge while admonishing the Political Secretary held that the CM Secretariat had no privilege to interfere police investigation. Tell your leaders that the judiciary is now independent, it cannot allow lawlessness, judge asked him to convey this message. Earlier, the judge had asked Chief Minister Shahbaz Sharif to look into the affairs of his secretariat and ensure no one should use his name, and if such interference from his office would not stop in future then he (judge) would summon him before the court. The judge held that in criminal cases even the DPO had no authority to take such action against an accused on bail or interfere into the affairs of investigation officer. The judge adjourned the hearing till next week and directed the DPO and CMs Political Secretary to come up after getting the petitioner compensated. Shabbir was involved in a criminal case who later obtained bail from Multan bench of High Court. He said the complainant of the case approached Political Secretary Mian Tariq and told him that police had not arrested the accused of the case. Then Mian Tariq directed the DPO Vehari to arrest the accused nominated in the case and police arrested him despite having bail and detained him for five days.
