LAHORE - The Model Town Society office-bearers are in troubled waters since an FIR has been registered against them allegedly for demolishing a nursery despite courts order against any such act, The Nation has learnt. The FIR has been lodged in Model Town Police Station on the complaint of the owner of the nursery, situated at E and F Block of Model Town Society. Moreover, the complainant Chaudhary Mukhtar Ahmad alleged in an application submitted in the office of Superintendent of Police (Investigation) Model Town that police officials, instead of arresting the accused but influential office bearers of the society and their accomplices, nominated in the FIR is favouring them and the investigation officer concerned released two arrested accused including convener of the society Qadeer Khan and security in-charge an ex-police man Saleem last night. However, the complainant while talking to this scribe told that when he contacted the investigation officer concerned of Model Town Police Station Sub Inspector Nisar Bhatti for recording his protest against release of both arrested office bearers of society, he told him that he compelled to do so due to pressure from the high ups. Later, the police officials, after releasing the both nominated persons in FIR also register a report against Irfan, a partner of nursery alleging him that he kidnapped both office bearers. In fact, police is protecting the influential office bearers of the society and the main objective of registration of cross report against Irfan is to built pressure on the complainant for withdrawal of FIR or as an effort for settlement, he alleged While giving details, as mentioned in FIR as well, he said that he got such piece of land of about 25 kanal and 2 marlas from Model Town Society on lease for establishing a nursery of plants. He said that about two and half years ago he smelled that the office bearers of Model Town Society wanted to grab such piece of land forcibly and unlawfully in breach of lease contract. As preventive measure, he filed a petition in the court of Rafaqat Ali Qamar Civil Judge against such breach of contract and the court awarded him stay order against act of MTS. But, in contempt of court orders, some persons namely Asif, Mehmood, Naeem Bari and Saleem took possession of a 14 kanals out of total about 25 kanals piece of land of nursery forcibly on behalf of the MTS despite the fact that a case of such land was pending in the court, he alleged adding that these persons on behalf of MTS continued assaulting his nursery unlawfully time and again for getting possession of the land of his nursery and they, with their over 50 accomplices, equipped with weapons demolished five structures of his nursery with stealing pesticides, seeds, debris of such structures including iron gates, windows, iron rods, guarders etc while smashing nursery. However, he filed a complaint in concerned police station against such persons and their attack on nursery while police despite visiting spot and finding that the contents of complaint were true, refused to register his report, which they would have to register on the basis of the copy of stay order of the court but after about four months, he added. When contacted, MTS President Tahir Kardaar said that the MTS is the sole owner of such land of nursery, which was leased out to the said owner of the nursery by the society for three years but later he did not deposit outstanding dues of about Rs 4,50,000 as lease amount with MTS, which declared him defaulter and refused to extend his lease. He said that about eight years ago the MTS formed a policy to lease out only four kanals of land to each nursery and all the owners of nurseries, functioning in MTS agreed with the policy except such person, who later went to court of Registrar Cooperative Housing Society against the decision of the MTS, which was rejected. However, the society bound to follow the laws concerned regarding housing societies only; he said adding that the MTS did not disobey any court orders in this regard.
