ISLAMABAD - Former Chief Justice of Supreme Court, Justice Saeeduz Zaman Siddiqui has reiterated that the deposed judges could be restored through a simple resolution in the Parliament, followed by an executive order. Talking to the media at the Supreme Court the other day, Justice Saeeduz Zaman Siddiqui said the case of the deposed judges and that of those who have taken oath under the Provisional Constitution Order (PCO), are absolutely different from each other. After restoring the deposed judges through a resolution passed by the Parliament, the issue of PCO judges could be solved in the light of Judges' Case (Al-Jihad Trust Case), Justice Saeeduz Zaman Siddiqui said. Saeeduz Zaman Siddiqui, contry's former top judge, who preferred to giving up the slot of CJ to pledge allegiance to Pervez Musharaf in 2000, when deposed CJ Iftikhar Muhammad Ch and others took oath under first PCO of General Musharraf's regime, once again disagreed that there was any need of a constitutional package to restore the deposed judges. Meanwhile, Secretary SCBA, Amin Javed Advocate asked Aitzaz Ahsan to quit the committee, formed to restore the deposed judges, if the lawyers' struggle was compromised. "Lawyers community will not associate itself to any such committee that undermines the aim of the lawyers' struggle to restore the deposed judiciary to pre-November 3, 2007 position, the day when President Musharraf imposed emergency in the country and sacked several judges of the superior judiciary through a PCO. Amin Javed demanded that the all the deposed judges should be restored on May 12, otherwise lawyers will continue their struggle for the instatement of the deposed judiciary. "We will not accept PCO judges in any case and no compromise will be made to retain the PCO judges", Amin Javed made it clear to Aitzaz Ahsan and other members of the committee for the restoration of judges. "Accepting the PCO judges is tantamount to betraying the cause of the lawyers' movement", Amin Javed pointed out. He also stated that the restoration of the deposed judges should not be clubbed together with any constitutional package and Murree Declaration should be implemented in its true letter and spirit. There was no mention of any constitutional package in Murree Deceleration, he asserted. Secretary SCBA that the lawyers are fighting for a national cause and would continue to take the campaign to its logical end. "We would not let their sacrifices go waste", he vowed.
