MUZAFFARABAD

The Supreme Court of Azad Jammu and Kashmir (AJK) while terming the Shariat Court Amendment Ordinance 2015 unconstitutional and illegal, declared the appointment of two judges of Shariat Court as null and void.

AJK Supreme Court bench headed by Justice M Tabbasam Aftab Alvi, was comprised of Justice Jehandad Mughal and Justice Azhar Saleem Babar. Declaring the appointment of Shariat Court judges - Mushtaq Ahmed Janjua and Sardar Shahzad Ahmed as null and void, ordered the AJK government to table ordinance in the state assembly within 30 days. The apex court also passed the order that appointments in the Shariat Court should be made under Shariat Court Act 1993 unless the assembly passes the ordinance.

The court, however, gave a legal cover to the decisions and rulings passed by the terminated judges.
