ISLAMABAD - The Islamabad High Court (IHC) Tuesday directed the authorities to hand over the dead body of a Baloch protester to the heirs and make arrangements for his burial to his native town Dera Bugti.

IHC judge Justice Noor-ul-Haq N. Qureshi also directed Secretary Interior and Chief Secretary Balochistan to take measures to ensure the shifting of the dead body of Bugti tribesman who was participating in a protest being held in the federal capital for the last two months, to Dera Bugti and his burial in the town.

Justice Qureshi decided the matter while hearing the writ petition of late Nawab Akbar Bugti's grandson, Nawabzada Gohram Khan Bugti, who filed the case before the IHC seeking custody of the dead body of one of his tribesmen who had died on July 3 during a protest for the rehabilitation of displaced Bugti tribes.

During the hearing of the case, Chief Commissioner Islamabad, Inspector General Islamabad Police and Assistant Commissioner Islamabad appeared before the court.

The IG Islamabad told the court that the administration was cautious due to law and order situation while the chief commissioner told that the family of the deceased had to pay arrears to a private hospital amounting 0.47 million rupees.

He further informed that the Islamabad administration had paid the said amount and ensured them to shift the dead body to Sukhar Airport via aeroplane.

Legal counsel for the petitioner, Baber Awan Advocate, told the court that the state institutions have become a symbol of harassment. These poor Baloch people had been protesting over two months in the federal capital and no one came to address their grievances.

Earlier, the IHC on Monday summoned Inspector General of Police (IGP) Islamabad, Chief Commissioner and Assistant Commissioner Islamabad to appear before the court today in the petition seeking custody of dead body of a Bugti tribesman.

After hearing the petition, Justice Qureshi had directed the IG Islamabad police, Chief Commissioner and Assistant Commissioner Islamabad to appear before the court and submit their reply in this connection. The petitioners Gohram Bugti and Dilshad Khan brother of deceased person approached the court through their counsel Babar Awan advocate and made Interior Secretary, IG Police Islamabad, Chief Commissioner, Assistant Commissioner and President Shifa International Hospital as respondents.

In the petition, they maintained before the court that the deceased Gulsher Ahmad was the real brother of Dilshad Khan while Gohram Bugti being elder of the tribe filed this writ petition and the second petitioner Dilshad Khan is a poor person and could not afford the legal proceedings. The petitioners told the court that they and their other tribesmen were forcefully driven out of their native place and for ensuring their right of rehabilitation, the tribesmen had been protesting in Islamabad for the last 66 days.

They informed the court that during their protest, Gulsher Ahmad fell ill and was admitted to Pakistan Institute of Medical Sciences (PIMS) where he remained under treatment for a few days.

They added that later, the patient was admitted to the Shifa International Hospital at the recommendations of the PIMS doctors but the patient could not survive and died. He was 22 years old at the time of his death.

Petitioner Dilshad Khan being legal heir of the deceased requested the Shifa Hospital to handover the dead body of his brother but they refused to give the custody of dead body of Gulsher to him.

Gohram Bugti then being elder of the tribe also requested to the hospital administration for handing over the dead body as they wanted to perform the burial ceremony at their native place but the hospital administration refused to do so.

The petitioner maintained before the court that when he requested the hospital administration for handing over the dead body, they told that chief commissioner Islamabad and Inspector General Islamabad police had given strict instructions not to hand over the dead body.

The petitioner has requested to the court to direct the respondents to handover the dead body to the legal heirs.

The court issued the directives in the case and disposed of the petition.
