LAHORE - Special Investigation Unit (SIU) of Anti Corruption Establishment has recommended judicial action against 12 persons involved in preparation of fake document attested by Supreme Court of Pakistan and transfer of State land to a citizen, said sources in ACE on Saturday. The accused included a senior judicial officer, a DDOR, some officers from revenue department and others. The matter has been under investigation since 2004. As per details Muhammad Jamil Khan, Nazim Union Council, Ghourgushti District Attock moved an application to the Chief Justice of Pakistan alleging that valuable State land measuring 10 Kanals and 10 Marlas was fraudulently transferred in the name of a fake character Ghulam Nabi using fake decrees of Civil Court, Lahore High Court and Supreme Court of Pakistan. The Chief Justice of Pakistan directed the District & Sessions Judge Attock to hold an enquiry and submit the report. The D&SJ Attock conducted an enquiry and submitted report finding that the allegations were correct. The report disclosed that a photo copy of fake certified copy, shown to be attested by the Superintendent Supreme Court of Pakistan, was used in the Civil Court for execution of decree. Consequently, the impugned mutation No 8868 dated June 26, 2004 in the name of Ghulam Nabi and sale deed No 1046 dated November 19, 2005 (whereby the land was transferred from the name of Ghulam Nabi to Safarish Ali Khan) were cancelled and the land was retrieved to the State. On the directions of the CJP, the matter was referred by the District & Sessions Judge Attock to the Anti Corruption Establishment for initiating criminal proceedings. The enquiry under the Punjab Anti Corruption Establishment Rules was conducted by Khalid Habib, Deputy Director, Anti Corruption Establishment Rawalpindi Region who submitted his report on February 13, 2007. On the recommendation of enquiry officer, case FIR No 02 on March 1, 2OO7 under section 420, 467, 468, 471, 218 of PPC and 5(2)47 PCA was registered with the Police Station, ACE, Attock. Investigation of the case was conducted by Circle Officer ACE, Attock who submitted final report on November 14, 2008 and revised final report on March 11, 2009 recommending judicial action against the following 10 guilty persons, which was approved by the Regional Director, ACE, Rawalpindi. The accused involved Raja Aftab Khalid, Naib Tehsildar, Rafaqat Hussain, Naib Tehsildar, Shahnawaz, Girdawar, Asim, Patwari and private persons including Safarash Khan, Muhammad Sheraz, Iqbal Khan, Ghulam Nabi (fake private person), Nasir Ali Advocate and Muhammad Ameer (Ahlmad, Civil Court Attock). On the representation of Rafaqat Hussain, Naib Tehsildar accused, the then Director General ACE, Punjab ordered for re-investigation of the case in 2009. The Circle Officer ACE, Attock conducted re-investigation and again recommended judicial action against the above mentioned persons along with DOR Attock Mehmood-ul-Hassan Zia and DDOR Attock Muhammad Arshad Warraich. Keeping in view gravity of the offence and the conflicting opinions of the investigators, the DG ACE entrusted for investigation on Nasir Javaid Basra, Member (Revenue) SIU and Sakhi Muhammad Kahut, Member (Judicial) SIU, HQ Anti Corruption Establishment Punjab Lahore directing to conclude the investigation within 14 days. The investigation team submitted report on September 1, 2010 recommending judicial action against the 12 accused persons.
