PA dissolution idea stirs debate

LAHORE A new debate has started in political and legal circles after head of the Unification Bloc asked the Punjab government to dissolve provincial assembly, apparently to get the Senate elections postponed. If the elections on 50 per cent seats of the Senate are held in March as per schedule with the current composition of the national and provincial assemblies, the ruling PPP is likely to win most of the seats. And therefore Dr Tahir Ali Javed, who leads the PML-Q dissident group, has suggested to Chief Minister Shahbaz Sharif to use his constitutional power and advise the dissolution of the provincial legislature. Dr Tahir denies that his idea had anything to do with the Senate elections but thinks that action on his 'personal advice would make fresh elections unavoidable for the rulers. The PML-N immediately distanced itself from the proposal, after which it became unclear why the legislator from Shakkargarh had floated the idea in the first place and who would support it if even the party ruling the Punjab was not willing to buy it. Dr Tahir told The Nation, Dissolution of the Punjab Assembly is his own idea and didnt enjoy the support of the Unification Bloc at the moment, but it is likely to receive wide support when he put it to the PML-N leadership and the provincial chief executive. He claimed that dissolution idea, which would pave the path for early elections, was the only way to get rid of the 'corrupt rulers. However, he agreed that it cannot be guaranteed that a new set up as a result of fresh elections would essentially end the miseries of the masses. When asked whether he would be ready to tender his resignation to become first raindrop for starting a campaign against an allegedly corrupt and inefficient government, he avoided giving a clear answer saying, I will float his proposal to the PML-N leadership and follow their directions. Some political circles believe that Dr Tahir floated this idea with the prior approval of the PML-N leadership to gauge the tilt in public opinion after the recent rioting against the loadshedding in an effort to evaluate the number of seats they could secure in case of early elections. However, rejecting this impression, the Unification Bloc leader recalled that the PML-N chief in a recent public meeting in Sindh had stated that they would not hesitate to sacrifice the Punjab government for the greater good of the masses. Dr Tahir also rejected the impression that his idea was aimed at delaying the Senate polls, in which PPP is expected to grab the major chunk. When reached, Senior PML-N leader Senator Pervaiz Rasheed also insisted that Dr Tahir gave the idea in his personal capacity and it had nothing to do with the PML-N leadership. He said that elections to Sindh, KP and Balochistan would be held even if the Punjab Assembly is dissolved. Senior PML-Q leader Senator SM Zafar opined that it was the right of a political force to make efforts for the conduct of the polls at the peak of their popularity. He however added that any political party desiring snap polls should keep in mind that any new elections would be held under a caretaker set up to be formed with the consent of President and Governor, who both in case of Punjab belong to the PPP presently. PML-Q Parliamentary Leader in Punjab Assembly Chaudhary Zaheerudin said that such a proposal should come from the real movers of the idea instead of a dummy like Dr Tahir. As the constitution is silent about such a situation, TheNation talked to eminent constitutional experts including SM Zafar, Akram Sheik, Khalid Ranjha and Ahmad Awais to elicit their opinion on the subject, and most of them opined that Senate elections would be held as per schedule even if one of the provincial assembly assemblies is dissolved. They were of the view that elections for vacant Senate seats from that particular assembly, which stands dissolved at the time of Senate polls, will be deferred till constitution of the new one within 90 days. They said that dissolution of one assembly could not be presented as an excuse to postpone the entire electoral process to fill the vacant seats in the Senate.
