islamabad - The Islamabad High Court will Tuesday (today) resume the hearing of a woman’s petition wherein the prolonged detention of her husband Muhammad Zakir, a soldier of Pakistan Air Force (PAF), has been challenged. Justice Aamer Farooq will conduct the hearing of the petition. The court has already issued notices to ministry of defence and directed it to come up with its comments on Tuesday. The petitioner Saeeda Akhtar through her counsel Col (Retd) Inam-ul-Rahim moved the Islamabad High Court for recovery of her husband. She cited the federation of Pakistan through secretary defence, chief of air staff, provost martial Pakistan Air Force and two others as respondents in her petition.

The petitioner adopted in the petition that on 8-10-2013, an incident took place at airbase when a soldier opened fire with his service weapon on other fellow soldiers and the husband of the petitioner also received bullet injuries. He was shifted to Combined Military Hospital (CMH) where he remained admitted till 8-11-2013.

She continued that the soldiers present on the crime scene attempted to overpower the firer and during the process, he resisted and got killed by his own weapon. The counsel for the petitioner informed the court that thereafter, the base authorities got the husband of petitioner forcibly discharged from the CMH on 8-11-2013.

, when he was yet under treatment and since then he has been under close arrest without any charge-sheet.

Therefore, the petitioner prayed to the court that the prolonged detention of her husband and the manner of the said detention both be declared illegal and in contravention of defence service laws and rules made there under. She also prayed that her husband might be produced before this august court and be set at liberty forthwith as hither to fore.

She also requested that the respondents be directed to release the pay and allowance of the petitioner’s husband forthwith.
