PESHAWAR - Peshawar High Court ordered election commission to restore the Provincial Assembly Membership of MPA Aizaz-ul-Malk from PK-95 Dir Lower and declared the decision of re-election on the same constituency as null and void.

Aizazul Malk had knocked the door of Peshawar High Court against the decision of election commission in which a petition was filed by some activist of ANP and NGOs regarding barring of woman voters to participate in the electoral process.

A two-member bench of Peshawar High Court comprising of Justice Mazhar Alam Mian Khail and Justice Irshad Qaisar had reserved the judgment and announced the decision on Thursday. The petitioner lawyer Ghulam Muhayudine informed the court that there was no record that woman were barred during the election as there are witness while several woman of civil society who were present on the occasion have forced the election commission to hold re-election.

He said that no one among the woman of the area has complained about their barring to participate in the election and as per the tradition of the area woman are least interested to participated in the electoral process.

During course of previous hearing lawyer for election commission Shamail Ahmad Butt argued that Election Commission is supreme body and it can decide any matter regarding the election process.

He said that if the petitioner has any objection regarding the decision of Supreme Court then they should file petition in Supreme Court.

However the court had reserved the verdict and announced detail decision on Thursday declaring the re-election process as null and void while ordering the election commission to issue notification regarding the success of MPA Aizaz-ul-Malk.

It is to mention here that in by-election held on May 7 2015, Jamaat-e-Islami candidate Aizazul Malk had secured 20,288 votes while his opponent of Awami National Party Haji Bahadar Khan obtained 16000 votes as runner up candidates.
