LAHORE - Despite passing orders for the last six months, court of LHC Chief Justice Khawaja Muhammad Sharif could not get Humaira Javaid, 14, recovered who was allegedly abducted on October 10, 2009, from Village Bhota, Tehsil Kharian, District Gujrat. The incident of girls kidnapping is still a mystery for everyone including her parents who say their daughter has been sold for Rs 25,000 to several parties after her kidnapping about eight months ago. The LHC chief justice who had taken suo moto notice of her kidnap on January 25 also dropped proceeding on Monday perhaps in a disappointing mood when police failed to produce the girl before the court 'despite all efforts. Disposing of the suo motu case on Monday, the chief justice remarked, Police made utmost efforts for recovery of the girl but she was not traceable till now. The CJ noted in the order that investigations in the case were transferred many times and police made efforts but Irshad Bibis daughter could not be found. The chief justice got impatient and threw the case file away when petitioner Irshad Bibi, mother of the kidnapped girl present in the court, dared to make a humble 'appeal for 'fresh orders to police to recover her daughter. Earlier, Superintendent of Police Gujranwala City Malik Muhammad Awais submitted a report in the court saying the girl seems to have married someone and no one knew where she was living. Speaking to the poor woman, the CJ said she might take her case to 'any other judge as he had done what he could do in the matter. It is pertinent to mention here that despite taking suo moto the CJ had ordered the petitioner woman to leave the court when she was leveling allegations against police especially the DPO Gujrat. Getting disappointed by the unkind remarks of the judge, the poor woman fell unconscious in the court and after a medical check up by a doctor of the court she was shifted to Mayo Hospital where she remained hospitalised for about two hours. Earlier, Irshad Bibi with tears in her eyes told the CJ that police and Deputy Advocate General Hanif Khatana were deliberately not producing the girl in the court as the accused had linked with DPO Gujrat who had toured the USA with his sponsorship as the accused family owned a big business in America. The hue and cry in the court irked the chief justice and he said some hard things to her besides passing orders for closing of the case, Irshad Bibi vs DPO Gujrat, with directions to police to carry on investigations on merit. Later, in the office of LHC PRO Irshad Bibi told reporters that now she had no hope of seeing her daughter or getting justice as the chief justice did not believe her tale and thought that instead of being kidnapped her daughter had married someone. She said it was strange that police did not trace or produce her daughter despite orders by the highest court of the province. She alleged Humaira Javaid was also brought to the office of DAG Hanif Khatana but he, having links with the DPO Gujrat and the accused, directed police not to present her in court as her one arm was fractured and she was making hue and cry. Fearing trouble they did presented her in the court, she further said. Muhammad Azhar advocate who has been appearing in the case along with the petitioner said the case being of habeas corpus nature could not be disposed of until the abducted person is once produced in the court. He said the CJ disposed of the matter in an unusual manner, which was not supported by law of the land. He said it was strange that despite court orders the girl could not be produced by police in the court, adding the order passed by the CJ showed helplessness on the part of the court. Irshad Bibi along with her husband Javaid Iqbal said accused Irfan s/o Raja Masood and his cousin Sohail Nasar kidnapped her daughter. The FIR was registered against Irfan, Sohail and four others under 365-B at Kakrali police station but they were on bail now. Javaid Iqbal told reporters that he was a poor man but he will kept on fighting along with his wife till her only daughter, only sister of his four minor sons, was recovered or found.
