SC urged to nullify LHC ruling in Sharifs' case

Islamabad - Top lawyer of the Punjab Government on Wednesday, told the apex court that Lahore High Court disqualified former Prime Minister Nawaz Sharif in undue haste without hearing the federal and provincial governments. Initiating his arguments on a set of appeals against a Lahore High Court ruling of June 23 last year that disqualified Pakistan Muslim League-Nawaz (PML-N) Quaid Nawaz Sharif from contesting bye-elections, Advocate General Punjab Khawaja Harris asked the apex court to nullify the LHC ruling and uphold the order of the Returning Officer. Besides declaring the elder Sharif disqualified, LHC had also asked the Election Commission to review the eligibility of Punjab Chief Minister Shahbaz Sharif. An application is also before the bench, which is seeking formation of a larger bench comprising those judges who had refused to take oath under PCO on November 3, 2007, for adjudicating on the eligibility of Sharifs. Appearing before a three-judge bench comprising Justice Moosa K Leghari, Justice Sakhi Hassan Bukhari and Justice Sheikh Hakim Ali which is hearing the petition, Khawaja Harris argued that the presence of Sharifs before the court was not totally required since the court was bound to deliver justice even in the absence of a party or a person. Pointing out the attendance of the Deputy Attorney General before LHC in the order sheet, Harris remarked that the counsel was marked as present on behalf of federal government but there was no mention of his ciontention on the issue in the judgment. Challenging the locus standi of Syed Khurram Shah, Advocate General Punjab said the fellow had no right to question the candidature of Shahbaz Sharif because the vote of the objector was not registered in the constituency of Chief Minister Punjab. Harris asked the apex court to nullify the LHC ruling and uphold the verdict of Chief Election Commission and Returning Officer (RO) regarding acceptance of nomination papers of the PML-N Chief. Earlier, Advocate A K Dogar counsel for Shakil Baig, seconder of Nawaz Sharif exchanged hot words with the bench at the outset of the proceedings. When the counsel stated that he humbly sought decision on his plea for larger bench before decision on merit in the case, Justice Sheikh Hakim Ali remarked that the bench knew very well how much humble the counsel was. "You have called us dishonest", the judge reminded the lawyer. Dogar stated that he required more time to argue his point. The court however refused to grant him more time and asked him to stop quarreling with the court. Subsequently, A K Dogar walked out of the tension-packed courtroom in an angry mood. Advocate Akram Sheikh, counsel for Mehr Zafar Iqbal, the man who proposed nomination papers of Nawaz Sharif from NA-123, also told the bench that he had not argued on the merits of the case and only submitted his arguments on application asking the incumbent bench to refrain from deciding the case.
