KARACHI- A two-member bench of Sindh High Court (SHC) comprising Justice Muhammad Ali Mazhar and Justice Shahnawaz heard former
president Pervez Musharraf s petition seeking removal of his name from Exit Control List (ECL).
In his arguments, Attorney General Salman Butt said Pervez Musharraf’s petition against ECL does not come under High Court’s jurisdiction. He said the two decisions, that were challenged, were issued from Islamabad whereas Pervez Musharraf was also a permanent resident of Islamabad.
The Attorney General told the court that the Sindh High Court (SHC) had heard the ECL case on April 8, 2014. Upon this, Justice Muhammad Ali remarked that the court would provide the opportunity to the parties as per the Constitution. Musharraf’s counsel Barrister Farogh Naseem argued before the bench that after the final decision of the Supreme Court the court’s earlier interim order had no value. He further argued that only a trial court would order about keeping the name of a person in the ECL .
Farogh Naseem said that cases against Pervez Musharraf were under proceeding in five courts but no court imposed restriction on the movement of the former president.  The bench after hearing the arguments adjourned the hearing of the case till May 20, 2014.
Later, talking to journalists, Barrister Farogh Naseem said that the government wanted to influence the court by putting Pervez Musharraf’s name on ECL . He said that name of any citizen cannot be put on ECL only with an administrative order.
In previous hearing , the government opposed Musharraf’s petition seeking the lifting of a travel ban on him to allow him to visit his ailing mother in Dubai. The government has filed its response in the Sindh High Court.
Musharraf’s lawyer said that the government in its reply said that since 70-year-old former president was required to make appearances in court in four different cases his name should not be taken off the ECL . The government also argued that in some cases Musharraf could face the death penalty and could abscond if his name was taken off the ECL .
Musharraf s name was put on the ECL on April 5 last year to ensure that he remains in the country and attends hearings of all the cases he has been named in.
