The Federal Board of Revenue (FBR) on Friday dismissed two officials under rule of the Government Servants (Efficiency and Discipline) Rules, 1973 with immediate effect.

The FBR has issued two different notifications in this regard. The Disciplinary proceedings 1973 were initiated against Sadar Amin Farooqui, Principal Appraiser (BS-16), MCC (Appraisement), Karachi (presently posted in MCC (Exports), Karachi) and Naimatullah Alvi, Principal Appraiser (BS-16), MCC (Appraisement), Karachi (presently posted in MCC (Preventive), Karachi) on account of various acts of omission and commission committed by the accused officer, constituting inefficiency , misconduct and corruption.

A two-member inquiry committee consisting of Dr Asif Mehmood Jah, Additional Director (BS-19), Post Clearance Audit, Lahore and Muhammad Farrukh Sharif, Deputy Director (BS-18), Internal Audit (Customs), Lahore was constituted to conduct inquiry in these two separate cases.

On the basis of inquiry report dated 19.08.2013 submitted by the inquiry committee, the accused Principal Appraiser Sadar Amin Farooqui and Naimatullah Alvi, Principal Appraiser were served a Show Cause Notice dated 04.09.201. In response, Sadar Amin Farooqui, submitted his defence reply dated 06.01.2014. Meanwhile, Naimatullah Alvi, submitted his defence reply dated 11.01.2014.

After considering the inquiry report, replies of the accused to the Show Cause Notice and their oral submissions during the personal hearing, the charge of "Inefficiency" under rule 3(a) of the Government Servants (E&D) Rules, 1973 has been established against them.

The Member (Admn) being the Authority in these two cases, after having considered all aspects of the cases and the recommendations of Authorised Officer has, therefore imposed the major penalty of "dismissal from service" upon Sadar Amin Farooqui, Principal Appraiser and Naimatullah Alvi, Principal Appraiser under rule 4(1)(b)(iv) of the Govt. Servants (Efficiency & Discipline) Rules, 1973 with immediate effect.

The two officials shall have the right of Appeal as admissible in the Civil Servants (Appeal)Rules, 1977.
