LHC dismisses plea filed by 3 terminated PCB officials

LAHORE Justice Iqbal Hameedur Rehman of the Lahore High Court Wednesday dismissed the petition earlier filed by three terminated officials of the Pakistan Cricket Board (PCB). The petitioners namely Col (r) Mohammad Pervez, GM Administration, Maj (r) Javed Arshad Khan, Manager Estate & Recoveries and Major (r) Ahmad Anwar, Manager Cricket Operations were terminated in 2007, which they challenged before this court. They had submitted to the court that despite the fact they had been honestly and diligently performing duties, the PCB during the tenure of Dr Naseem Ashraf terminated their services without issuing them any notice or holding inquiry against them on any complaint if that was ever filed against them. They alleged that they were sacked on political grounds and had been victimised without any reason. The petitioners also claimed that they were regular employees of the PCB and they could not be sent home without issuance of show-cause notice or inquiry. Petitioners prayed to the court to set aside their termination orders while declaring them null and void and direct the PCB to restore them. PCB counsel Taffazul Haider Rizvi while opposing these petitions said that the Board did not have the statutory rules, therefore, the principle of master and servant was applicable as such no writ for reinstatement was competent. Referring different Supreme Court verdicts, he submitted that the only remedy available to the dismissed employees was a suit for damages. He also asserted that since it was a dismissal in simplicitor without stigma, therefore no show-cause or inquiry was warranted under the law. The judge accepting the contentions raised by the PCB counsel dismissed the petitions.
