OUR STAFF REPORTER LAHORE A Lahore High Court bench on Friday rejected the plea made by Jahanzeb Niazi to restrain his Canadian common law partner Roshni Desai from taking the child to her country and also ordered return of the mothers passport. The LHC bench gave custody of three and a half years old Muslim minor, Azan, to his Hindu mother, overruling the claim of Muslim father mainly on the ground, the child was extramarital (Illegitimate) which warranted custody to the mother. The respondents counsel Binyamin Khalil Chaudhry stressed that a Muslim child could not be handed over to a non-Muslim mother under Islamic laws. The Court, however, rejected the argument and observed that under Islamic law a father had no right of custody over an illegitimate child. An illegitimate child has to be given to mother only, the judge added.
