Musharraf ECL Case: SC to hear the petition this week

Islamabad- Supreme Court (SC) has admitted for hearing a petition filed against the Sindh High Court (SHC) decision on removal of Pervez Musharraf from ECL and directed SC office to fix it for hearing in the current week.

Justice Saqib Nisar has remarked “ fixing  cases in any bench for hearing is domain of Chief Justice of Pakistan (CJP) . We will hear it when he comes. On the other hand the original petition is not with us for the purpose of hearing.
Justice Asif Saeed Khosa has remarked “Sindh High Court (SHC) has given the time of 15 days then what is the need to become so hasty. We will hear it in next week. Justice Ejaz Afzal Khan observed “how can we issue order in respect of a matter which is not before us.
A 3-member bench of SC presided over by Justice Saqib Nisar took up the case for hearing Monday. Attorney General (AG) appeared before the court and told that the matter was of public interest therefore, it should be heard as soon as possible and it will be better if it is heard today.
The court remarked “ the matter before it is to hear the case early. The original petition is not before it for hearing nor any number has been marked on it. We go to say the office to mark number on it. AG said if the matter was delayed then petition  would become ineffective. The court remarked “ you have 15 days and we can ask  that the matter be fixed for hearing this week. The court while adjourning the hearing of the case referred it to the CJP for constitution of new bench.
