LHC seeks NAB reply for failing to act against former IG prisons ex-superintendent in hot waters

Rawalpindi-Lahore High Court Rawalpindi Bench on Tuesday issued notices to Chairman and Director General National Accountability Bureau in a contempt petition for failing to comply with an order against former inspector general of police prisons and ex-superintendent Adiala Jail for their alleged involvement in massive corruption. A divisional bench of LHC comprising Justice Shamas Mehmood Mirza and Justice Khalid Mehmood Malik issued notices and sought reply till 14/2/2018 from Chairman NAB Justice and DG NAB Rawalpindi. 

Earlier, Nazim Hussain Shah, a former senior clerk of Adiala Jail, had filed a petition number 2207 of 2016 before the LHC Rawalpindi Bench while making Chairman NAB, DG NAB Rawalpindi, Chief Secretary Punjab, Home Secretary Punjab, DG Anti Corruption Punjab, Director Anti Corruption Rawalpindi, Mian Farooq Nazir, the former IG Prisons and Malik Mushtaq Ahmed Awan, the former superintendent Adiala Jail the respondents.

In the petition, the petitioner told court he was serving as senior clerk in Adiala Jail and had highlighted the massive corruption of former IG Prisons and ex-Superintendent Adiala Jail on every platform. To avenge him, he added, two top officials of the prison department sent an armed gang of men who fired gun shots at him near Gulshanabad. As a result, he received bullet injuries. The petitioner told court he had also approached NAB and Anti Corruption Department and filed applications for legal action against the two police officers but in vein. He told court he was removed from service by former IG prisons on charges of corruption which later proved to be a lie. The petitioner prayed to the court to direct the Chairman and DG NAB to proceed as per law against the two corrupt officers of prison department. He prayed his applications are still pending with Chairman and DG NAB and no action is being taken against the corrupt officers.

On this, a divisional bench of LHC comprising Justice Sardar Ahmed Naheem and Justice Muhammad Tariq Abbasi ordered Chairman to proceed with the application in accordance with law. However, Chairman NAB violated court orders and did not initiate inquiry against the two corrupt officers.

Nazim Hussain Shah, the petitioner, had moved a contempt writ through his lawyer Raja Shujah Ur Rehman praying to the court to summon Chairman and DG NAB for violating court orders. The divisional bench of LHC Justice Shamas Mehmood Mirza and Justice Khalid Mehmood Malik issued notices to Chairman and DG and sought their reply till 14 February 2018.

Talking to media men, Nazim Hussain Shah, the petitioner, said he had appeared before Chairman NAB on 28/12/2017 along with all the substantial evidences of corruption of ex-IG Prisons Mian Farooq Nazir and former Superintendent Adiala Jail Malik Mushtaq Ahmed Awan. He said that Chairman NAB pledged to hold inquiry against the corrupt officers but despite a passage of 20 days, no inquiry was held.
