KARACHI - Father of Naqeebullah Mehsud Monday expressed lack of confidence on the trail court by submitting an application seeking transfer the case to another court.
During hearing on bail application filed by main accused, suspended SSP Malir, Rao Anwar, and four other accused, in Naqeebullah murder case. The accused including Rao Anwar were produced before the court in tight security. The court heard arguments from the accused lawyers, however, the complainant’s lawyer requested the court not to hear the matter as an application was submitted in the Sindh High Court to transfer the case from the trail court to the other court. The complainant laywer, Salahuddin Panwar advocate boycotted the court proceeding as the judge did not consider his plea. The court adjoined the hearing on the bail plea of the accused till Tuesday.
The complainant’ counsel has submitted a statement on behalf of his client that pleaded the court to transfer the case to another court as he has lost confidence in the ability of Special Judge Anti-Terrorism Court-II Khalida Yaseen to conduct a fair trial.
The judge was informed that an application was also submitted to the Sindh High Court in this regard. “Our pleas have not been heard from the very first day.” “The judge has not taken any notice of the protocol provided to the accused,” he added. Moreover, the father also stated that the witnesses in the case were being threatened and further requested the court to transfer the case.
Therefore, transfer applications have been filed before the Sindh High Court for the transfer of the Special Case 323/2018 and Special Case 427/2018 & 428/2018 (arising out of FIR No. 142/2018) to another competent court of law.
It was requested by the complainant that the case be adjourned until the transfer applications are decided. However, the complainant stated that he is extremely disappointed that despite informing the court that he has filed transfer applications and he has no confidence on the court, the court still proceeded with the bail application which clearly proves that no justice is possible in this court. The main suspect, Rao Anwar, who got bail in the main case, has filed bail in another case.
The suspended SSP and his 11 detained subordinates along with around 15 absconding officers are accused of abducting an aspiring model hailing from South Waziristan, Naseemullah, better known as Naqeebullah Mehsud, for ransom and killing him with three other detainees by dubbing them as ‘militants’ in a staged encounter in Malir on Jan 13.
