MIRPUR (AJK) - Azad Jammu and Kashmir Supreme Court, while admitting a writ petition, has issued a stay order barring Azad Jammu and Kashmir Council (Upper House of the AJK Parliament) and the Chairman AJK Council (the Prime Minister of Pakistan) from reopening or reviewing the appointment of the incumbent Chief Justice of the AJKs apex court Justice Muhammad Riaz Akhtar Chaudhry. The Full Bench of the apex court comprising Chief Justice Mr Justice Muhammad Riaz Akhtar Chaudhry and the judges Mr Justice Khawaja Shahaad Ahmed and Mr Justice Muhammad Azam Khan, on a writ petition, filed through counsel Khawaja Muhammad Nasim advocate, ordered the AJK Council and Chairman AJK Council/Prime Minister of Pakistan to restrain from issuing any further advice or reviewing or reopening the advice regarding the appointment of sitting CJ of AJKSC Justice Riaz Akhtar Chaudhry which has already tendered by AJK Council and acted upon. The court also directed the Law, Justice and Parliamentary Affairs Department of AJK to restrain from issuing any notification if any further advice was issued by the AJK Council. The learned Full Bench of the AJK SC also directed the AJK President to restrain from passing any order, issuing notification and administering oath to any other person for the office of Chief Justice of AJK Supreme Court till further orders. 'This order is subject to objections from the other side, the learned court declared in its order. The learned court said in its stay order 'it is a very important case because for the first time the judiciary of Pakistan wants to invoke its jurisdiction in another country. Before this, it never happened. The judiciary of Pakistan in various cases held that the Azad Jammu Kashmir is a separate State and the Supreme Court or the High Court of Pakistan has no jurisdiction in AJK so the petition filed under Article 184 before the Supreme Court of Pakistan is not a petition against an individual but it is a petition against the Constitution of AJK, office of President, Legislative Assembly, AJK Council and the whole nation of AJK, therefore it is the basic responsibility of all the judges of the AJK State except one who filed petition under Article 184 to hear this case and decide it because it is not an ordinary case. It is the question of institutions of State, solidarity of State and the future of generations of this state of AJK. Therefore, we the judges of the Supreme Court of Azad Jammu & Kashmir are hearing this case, it added. The learned court further said in its order 'important points of jurisdiction, interpretation of law regarding status of AJK and AJK Interim Constitution Act - 1974 are involved in this petition, therefore, it is admitted for regular hearing. Notices shall issue to the respondents to file written statement on or before the next date of hearing, it added. It may be said that a judge of the AJK Supreme Court Justice Manzoor Hussain Gillani has challenged the appointment of the incumbent Justice Muhammad Riaz Akhtar Chaudhry as the Chief Justice of AJK Supreme Court in the Supreme Court of Pakistan by the Prime Minister of Pakistan in his capacity as Chairman AJK Council with the contention that the sitting CJ AJK Justice Riaz was junior to him and was superseded to the top-slot despite his-self (Justice Gilani) as senior most judge of the Apex Court.
