IHC admin to file case against dismissed judge

ISLAMABAD - A day after dismissing Additional District and Sessions judge Pervaizul Qadir Memon on corruption charges, the Islamabad High Court administration has decided to register a case against the terminated judge with the FIA, sources said.

The sources said that the IHC administration would include a section of anti-corruption law and sections of Pakistan Penal Code in the case. The case would be registered after the approval of the IHC Chief Justice.

On October 31, 2016, Memon had acquitted CEO Axact Shoaib Ahmed Shaikh and 26 others in the fake degrees scandal. After the admission of Memon of taking Rs5 million as a bribe on May 5, 2017, he was suspended on June 7, 2017.

A notification issued by IHC Registrar Raja Jawad Abbas on February 16 said: “Mr Pervaiz-ul-Qadir Memon, AD&SJ [under suspension], was proceeded against under the Islamabad Judicial Service Rules, 2011 read with Punjab Judicial Service Rules, 1994 and Punjab Civil Servants [Efficiency and Discipline] Rules 1999, on the charges of corruption, admission regarding illegal gratification to the tune of Rs5 million for acquittal of accused [Shoaib Ahmed Shaikh] through judgment dated 31.10.2016 in case titled as “The State vs Shoaib Ahmed Shaikh.”

According to the notification, “Memon had admitted receipt of illegal gratification before a departmental promotion committee (DPC) on May 24, 2017, and DPC had recommended imposition of a major penalty that is removal from service on him.”

After perusing DPC recommendations dispensed with the inquiry proceedings under Rule 6 sub-rule 3 of Punjab Civil Servants [Efficiency and Discipline] Rules 1999, IHC Chief Justice Muhammad Anwar Khan Kasi as authority, issued a final show cause notice to the accused, Memon, as to why he should not be removed from service.

The IHC chief justice had also offered a personal hearing to Memon. The said notification concluded that “the IHC chief justice acting as authority ordered imposition of major penalty on the accused Memon with immediate effect”, the notification said.
