LAHORE - A judicial magistrate Faisal Jamil on Monday further extended three days physical remand of Munaaf Kalia, Javed Khanani and their co-accused Tariq Mahmood involved in scam of illegal transfer of dollar aboard while sent Rustam Ali to jail on judicial remand. The magistrate was able to extend remand after defence counsels lost a hard-fought legal battle in the court of sessions judge who dismissed their petition challenging jurisdiction of magisterial court in the instant case. The accused were produced before the magisterial court on Monday morning where defence counsel informed the court that they had challenged court's jurisdiction to award physical remand before the sessions court. They also alleged that the accused were subjected to torture in FIA custody. The court stopped hearing to wait for the decision from sessions court. Then the accused were brought to sessions court where they had also moved their bail applications. The defence counsels Akram Sheikh, Sharjeel Adnan and Naveed Farooqi submitting that the FIA had arrested them on November 5 and obtained their physical remand from the court of a local magistrate which later extended for more three days. Counsel for Javed Khanani pleaded that a judicial magistrate neither hear a case registered under section 23(a) of Foreign Exchange Act 1947 nor give remand. He further said the magisterial had violated his power by extending remand. They pointed out that the offences were bailable and police could not detain them. But FIA still had been keeping their clients in its illegal custody. Therefore, he argued, the physical remand of Khanani obtained by FIA was illegal and unlawful and his client's bails application should be accepted. He prayed before the court that his clients should be released on bail as they were not involved in any money laundering case. Counsel for Rustam and Tariq, both arrested from Gujranwala, argued that they are employees of Duniya Enterprises and do not have the resources to run a business on massive scale. He pointed out that Rustam was 75-year-old while Tariq is a computer operator and both had no direct link to K & K. While the prosecution lawyer, Azam Nazir Tarar, argued that these habeas corpus applications have been filed to harass the judicial magistrate and it was not right to say that the judicial magistrate has no jurisdictions to give remand of accused. He said that the accused had not only caused huge loss to national kitty but their illegal activities also opened a floodgate of price-hike in the country. He said after the arrest of Khanani and Kalia the dollar price has decreased that is enough proof of their guilt. The sessions judge after hearing all parties for two hours dismissed the petitions observing that the magisterial court had power to grant physical remand in the case. After that the accused were again produced in the court of magistrate Faisal Jamil where defence counsel opposed grant of remand on the plea that FIA authorities had tortured the accused therefore to give the accused in their custody would be highly unjustifiable. However the court granted three days remand of three accused and sent fourth one to jail on judicial remand.
