LAHORE - Shahid Aziz Butt, famous as Gullu Butt , has been denied bail by the Lahore High Court.
An anti-terrorism court had sentenced Gullu Butt to 11 years and three months in jail on vandalism charges in Minhajul Quran Secretariat last June, when the Punjab police attacked Minhajul Quran.
In his petition, Gullu Butt had requested the court for suspension of his conviction and release on bail. However, the Lahore High Court dismissed his appeal on Thursday.
A two-judge bench comprising Justice Abdul Sami Khan and Justice James Joseph heard the case. The bench held that many judgments of Supreme Court discouraged suspension of the sentence, particularly the sentence awarded by ATC, before final decision of the main appeal against the punishment.
The appellant told the bench that the trial court convicted him without hearing him and lacked merits. He pleaded the bench to suspend his conviction and release him on bail.
On the other hand, a deputy prosecutor told the bench that the Supreme Court recently issued a judgment and ruled that only the apex court had the jurisdiction to suspend sentences awarded under the anti terrorism law. “The LHC has no jurisdiction to suspend the sentence awarded by anti-terrorism act,” he contended.
