ISLAMABAD - The Supreme Court on Thursday asked the concerned authorities to repatriate member Malir Development Authority to its parent department in the federal government.

A two-judge bench comprising Justice Amir Hani Muslim and Justice Dost Muhammad heard the case regarding posting of Atta Muhammad Panhwar as member of the MDA in violation of the apex court orders.

Chief Secretary Sindh, Additional Secretary Establishment Division and Secretary Services, Sindh appearing before the bench tendered unconditional apology and assured to withdraw the notification of Panhwar posting as member of the MDA.

Accepting the unconditional apology, the bench observed that Secretary Establishment Division was bound to comply with the apex court orders in Panhwar matter and should have been repatriated to his parent department.

The court was informed that Panhwar was posted as member of the MDA after obtaining the advice from Ministry of Law.

The judge remarked how law department gave different opinion from the court’ verdict, saying the conduct of Secretary Services Sindh was also inappropriate, adding that before posting Panhwar in the MDA he should have to seek further directions of the apex court in the matter.

Justice Hani said: “This is something which we will not allow as it is against the Supreme Court judgment.” He said therefore directives were issued to repatriate Panhwar. He questioned why the Sindh government extended support to Atta Muhammad Panhwar.

Taking serious note of non-framing Malir Development Authority rules since 22 years the bench observed that the concerned authorities deliberately failed to frame the rules.

As the court was dictating order, Atta pleaded that his salary was not released since 2013. The court asked the Additional Secretary Establishment to look into matter.

The court in the last hearing had suspended the notification of Atta Muhammad Panhwar as member of the MDA and had sought explanation from the Federal Secretary Establishment, Chief Secretary and Secretary Service Sindh, while the record of Panhwar’s appointment as member MDA was also summoned.
