LAHORE - The Lahore High Court (LHC) on Monday expressed dismay over police performance while restraining them from harassing family members including women of an accused wanted by police in few cases.

Justice Abdul Sami Khan passed the orders on a petition moved by Muhammad Fiyaz Ahamd through Advocate Ishtiaq Ahmad.

The counsel submitted Muhammad Awais, son of Fiyaz Ahmad, was involved in criminal activities, resultantly police registered cases against him. After coming into knowledge about the activities of his son, the petitioner disinherited Awais and turned him out of the house located at Garhi Shahu area, Fiayaz submitted.

But, Garhi Shahu Police Station SHO Shahid Ali Gujjar and investigation head of the Racecourse police station Ashfaq Butt were continuously raiding his house and humiliating his daughters, wife and other family members, the petitioner contended. He stated that he had informed the police about disinherit-ness of his son but in vain.

He pointed out that police officials were demanding bribe for stopping the illegal raids on his house and threatening for dire consequences.

The petitioner said he had moved applications before the high-ups of the police against the raids but no one was paying heed to his problems.

He requested the court to restrain police from raiding his house and threatening his family members. He also requested the court to bar police from humiliating his family members, especially the women.

Justice Abdul Sami Khan heard arguments and observed that police could not harass family members of any accused.

Expressing displeasure over police performance, the judge restrained the police officials from raiding the petitioner’s house in order to arrest accused Awais.

NOTICE: The LHC took notice on seven incidents of police highhandedness in the Punjab highlighted by different dailies.

The head of complaint cell of the LHC issued notice to the authorities concerned for report regarding the matters. Among these cases, three are regarding death of accused in police custody. The first one is of Toba Tek Singh wherein the police tortured to death one Mahboob Alam and threw his body near graveyard.

In Khanqan Dogran, the police arrested Zafar Ali and subjected him to severe torture which caused his death. The cell has asked district and sessions judges concerned to file report in this regard within a week.

ADJOURNED: The LHC adjourned the proceedings of petitions against constitution of parliamentary commission for formation of Bahawalpur Janoobi Punjab Province for further arguments until February 20.  Justice Khalid Mahmood Khan of the LHC put off the hearing due to lawyers strike against killings in Quetta. On previous hearing, the petitioner’s counsel, Advocate Muhammad Azhar Siddique, submitted that the commission was illegally constituted by the president through an illegal letter to the deputy speaker of the national assembly.

A group lawyers had challenged the formation of parliamentary commission and its recommendations for inclusion of Mianwali district into proposed BJP.

The petitioners had contended that neither the constitution nor the rules of business allowed the national assembly speaker to form a commission on new provinces’ subject. They said inclusion of Mianwali district in proposed province was against the will of the local citizens.

They pointed out the Punjab Assembly had passed two resolutions on the subject matter and demanded the restoration of Bahawalpur province instead of creation of new one. They said the incumbent rulers had no mandate for creation of a new provinces and such act will amount to upset administration system of whole country.

REMOVED: The tribunal of Punjab Bar Council headed by Justice Sheikh Najamul Hassan removed name of a fake lawyer from the roll of advocates.  According to a circular issued here Monday, name of Pervaiz Aslam Chaudhry, son of William Jhon, resident of D-Block, Mian Road, Youhanabad Colony, had been removed from the roll of advocates maintained by the provincial bar council.  Perviz Aslam had submitted forged LLB result card for obtaining licence for practice.
