LAHORE A Division Bench of the Supreme Court on Wednesday observed that the courts do not act at will but within the framework of the Constitution and the law. As such it is wrong to conceive that Supreme Court can do anything. The Court cannot go beyond limits of the book (the Constitution. This was stated by Justice Jawwad S Khwaja while holding the Bench with Justice Mian Saqib Nisar to hear the appeal filed by one former Senior Vice President National Bank of Pakistan. The petitioner, Muhammad Ismail Malik who wanted reinstatement in the office after he accepted the golden hand-shake in 1998, stressed the court for doing anything to provide him relief as the court was competent to do it. On it Justice Jawwad said it was a wrong impression that the court can do anything at will and whim. The Judge said court strictly goes by the Constitution and the law and not beyond that. The petitioner contended that he accepted the golden handshake scheme under duress and also accepted withdrawal of the GHS amount of Rs 40.87lakh with the same spirit.
