ECP warns parties of delisting

ISLAMABAD –  The Election Commission of Pakistan has issued show cause notices to at least 317 political parties, which have not yet fulfilled the requirement under the Election Commission Act. The parties have been warned of de-listing if they fail to fulfil the requirement.

Under the Election Act 2017, the political parties have to submit a list of at least 2,000 members with their signatures and identity cards and an enlistment fee of Rs200,000.

According to a notification issued by the ECP, political parties including the Pakistan Tehreek-e-Insaf, the Muttahida Qaumi Movement (MQM), the Pak Sarzameen Party (PSP), the Jamaat-i-Islami and the Jamiat Ulema-i-Islam (JUI-F) and others have been asked to submit their replies within 15 days of the notice.

The ECP said the registration would be suspended of those parties, which would not submit details.

According to the ECP show cause notice, “with reference to this commission’s notice dated the 20th October, 2017 and subsequent reminders dated 14th November, 2017 and 24th November, 2017, political parties were advised to fulfil and company with the provisions of Section 202 (4) of the Election Act, 2017 read with Rule 154 (2) of the Election Rules 2017 and submit a list of at least 2,000 members with their signature and thumb impression along with copies of National Identity Cards in Form 64 and proof of deposit of 200,000 rupees in favour of the Election Commission in the State Bank of Pakistan or the National Bank of Pakistan as enlistment fee in the head of account ‘03-Miscellaneous receipt, C038-others, C03870–others (Election Receipt)’ for enlistment of political parties within 60 days from the commencement of the Act by 2nd December, 2017.”

It further said, “Section 202(5) says that if an enlisted political party fails to comply with the provisions of sub-section 4 of Section 202 as noted above, the Election Commission of Pakistan shall cancel the enlistment of that political party in terms of Section 202(5) of the Act after affording and opportunity of being heard to that political party. Now, therefore, in compliance of the provision of Section 202(5), since your party has failed to comply with the provision of Section 202(4), therefore, you are asked to show cause as to why the enlistment of your party may not be cancelled by the Election Commission of Pakistan.”

The notice further said, “Your reply to this show cause notice should reach the election commission within 15 days of the issuance of this notice failing which one-sided action shall be [taken] against you and your party shall be delisted.”
