Governor violated LHC’s instructions, Parvez Elahi committed sheer violations of Constitution: Hamza

The Punjab governor violated Lahore High Court’s instructions whereas Chaudhry Parvez Elahi committed sheer violations of the law and the Constitution in the formation of new government. He said that the largest province of the country had been passing through constitutional crisis for about last one month.

The chief minister said that the Supreme Court of Pakistan had to intervene to protect and uphold the law and the constitution.

He said it was very unfortunate that the personalities were given preference before the Constitution of the country and added that it was a humiliation of the people of the province. He thanked Almighty Allah for being elected chief minister of the province. Hamza Shehbaz said he was a worker of the Pakistan Muslim League Nawaz PML-N and Muhammad Nawaz Sharif and Prime Minister Shehbaz Sharif are his leaders.

Meanwhile, a Lahore High Court (LHC) division bench on Saturday referred an intra-court appeal, challenging single bench orders for Hamza Shehbaz oath taking, to the LHC chief Justice with a request to form a larger bench for its hearing.

The bench noted that many important law points had been raised through the appeal, therefore, it was necessary to form a larger bench for hearing. The court also expunged paragraph 9 of single bench orders.

Justice Sajid Mehmood Sethi and Justice Tariq Saleem Sheikh heard the appeal filed by several MPAs of PTI. On Friday, a single LHC bench had asked Speaker National Assembly to administer oath to newly elected Punjab Chief Minister Hamza Shehbaz while allowing third petition filed for the purpose.

Hamza Shehbaz said the Chief Minister’s post will remain dedicated to the real public service. He vowed to use Chief Ministership for public welfare purpose only.

More interestingly, Punjab Governor Omer Sarfraz Cheema on Saturday rejected resignation tendered from Chief Minister Punjab Usman Buzdar and had written a letter to Speaker Punjab Assembly Parvez Elahi to convey the decision.

The speaker has received the letter from governor Punjab which stated that the resignation did not fulfil requirements under sub-section 8 of Article 130 of the Constitution. “Usman Buzdar addressed prime minister in the letter which was unconstitutional,” he said.

Meanwhile after rejection of Usman Buzdar’s resignation, the Punjab cabinet has also been restored and a meeting of it has been summoned at Punjab Assembly under the chair of Usman Buzdar.
