LAHORE (APP) – Lahore High Court Chief Justice Umar Ata Bandial Wednesday dismissed a petition challenging the appointment of Auditor General of Pakistan (AGP) Buland Akhtar Rana.

The chief justice observed that it was a constitutional post and remedy is available against such appointment, therefore, the petitioner must use available remedy first. The petition was filed by Pakistan Tehreek-i-Inqalab President Ilamudin Ghazi.

The petitioner submitted that Rana had been appointed as AGP though he was a controversial personality. He contended that the AGP’s post was a constitutional one; therefore, the respondent did not deserve to be appointed as the AGP. He requested the court to declare the appointment as illegal and unconstitutional.

Separately, the Lahore High Court dismissed a plea seeking disqualification of former PML-N MNA Malik Riaz for having a fake degree. Earlier, the single bench comprising Justice Khalid Mehmood reserved the verdict after hearing arguments of both parties. The petitioner submitted that the former MNA who was elected from NA-118 in 2008, contested elections on the basis of a forged BA degree from Azad Jammu and Kashmir University. He contended that the respondent did not qualify as per conditions set in Article 62 and 63 of the constitution. He pleaded the court to disqualify the respondent.

However, the respondent’s counsel alleged that the petitioner had occupied a piece of land reserved for hospital and he moved the court after it was vacated from him. The counsel pointed out that the Azad Kashmir Supreme Court had already given his verdict over the the matter, therefore, it should not be heard.

Hearing against Musharraf: The Lahore High Court deferred hearing on a petition seeking ban on Pervaiz Musharraf and his political party All Pakistan Muslim League (APML) for doing politics.

The registrar’s office will fix next date of hearing.

The petitioner Hayat Kalasan pleaded that Pervaiz Muhsarraf abrogated the constitution, deposed and detained judges of superior courts that caused irreparable loss to the country.

He requested the court to declare Musharraf disqualified permanently for participating in election and ban his party APML.

Court declares CIA officals POs: Additional District and Sessions Judge Rai Muhammad Ayub Khan Marth Wednesday declared proclaimed offender and issued perpetual arrest warrants for three CIA Ghaziabad officials, accused of killing a father of seven. They included Assistant Sub-Inspector Shakeel Ahmed Butt, Constables Muhammad Ahsan and Mahboob Elahi.

Later, the court directed the CIA SP to appear before the court to submit explanation in this regard but he did not turn up. Not only this, the judge also directed the CCPO to depute an officer not below the rank of DSP to arrest the accused but the CCPO treated the court's orders in same manner. During the course of proceedings, the court issued many show-cause notices along with bailable and non-bailable arrest warrants for the accused but all in vain.
