PESHAWAR - A two-member bench of Peshawar High Court on Thursday directed the political agent of Khyber Agency to appear before the court and explain his legal position for arresting two minor brothers from a school in Bara tehsil of the agency. According to details, Mst Shan Bibi, resident of Tehsil Bara, Khyber Agency, filed a writ petition in PHC stating that the agency forces picked up her two minor sons - Syed Azeem, 12, and Syed Ijaz, 11, from their school at Bara on January 1, 2010. She said since then they could not trace their whereabouts. The applicant requested the court to direct the political agent and school administration to recover her children. The court while taking action on the petition issued notice to the school principal to appear before the court and clarify his position in this regard. On Thursday, the school principal appeared before the court and stated that a group of Khasadars of Khyber Agency sent by the political agent came to their school and took the custody of both the brothers. A written statement about arresting the minors has been taken from them, the principal informed. Later, the school principal presented the signed statement to the court. The bench comprising Justice Dost Mohammed Khan and Justice Fasihul Mulk after examining the statement of the school principal issued notice to the PA and ordered him to appear before the court and inform the court about the whereabouts of the minor brothers. The court also allowed three weeks deadline to the interior ministry for clarifying their position in this regard. Meanwhile, another divisional bench granted fortnight to interior ministry in the case of another missing person. In a writ petition filed by Mst Gulnaz Bibi, wife of Syed Akber Shah, resident of Badrashai, Nowshera, she complained that her son Syed Kamran Shah was arrested by the security forces on January 26, 2010. She said since that date her son was neither released nor he was produced before any court. She appealed to the court to direct the security agencies to release her son. Te bench chaired by Chief Justice Ijaz Afzal Khan and Justice Mazher Alam Miankhel earlier directed Attorney General for explain the ministry stance in this regard. On Thursday the DAG request for granting fortnight time. The court accepted the request and allowed time for submitting reply regarding the missing person.
