RAWALPINDI Lahore High Court (LHC) Rawalpindi bench Monday directed police to register an abduction case against Superintendent Adiala jail in a petition moved by the families of 11 persons who were acquitted by the Anti-Terrorism Court (ATC) in various terrorism cases but instead of releasing the 11 men, jail authorities allegedly handed them over to some intelligence agency. LHC judge Justice Chaudhary Muhammad Tariq also directed police to arrest the Jail Superintendent Saeedullah Gondal after registering First Information Report (FIR) of criminal case against him in Police Station (PS) Saddar Bairooni. The court further ordered to submit the report in the court within 15 days in this regard and adjourned the proceedings till next date of hearing. The families of 11 persons moved the court through their lawyers advocate Basharatullah, advocate Ilyas Siddiqui and advocate Tariq Asad and told the court that jail authorities had not released the persons on court orders. Earlier, the court had issued summons to Superintendent Adiala jail and directed him to respond and explain why the detained men were not handed over to their relatives after their detention orders were declared illegal by the court. The petitioner Syed Abdul Baais through his lawyer made superintendent jail and an additional district and sessions judge as respondents. In his petition, he stated that his three brothers Abdul Basit, Abdul Majid and Abdul Saboor with eight other men were not released by the jail administration despite the May 27 LHCs orders. He told the court that he along with his lawyer approached the jail authorities on May 28 for the release of his brothers after their detention orders were declared illegal by the court and they had already been acquitted in different terrorism cases. However, he continued that the jail authorities kept them waiting and instead of releasing the eleven men handed them over to some intelligence agency. Terming this step of the jail administration as illegal, the petitioner asked the LHC to order the registration of criminal case against the jail head for keeping the men in illegal detention. He said that he along with the relatives of the other men remained present outside the jail on whole night between May 28 and 29 but the jail officials instead of complying with court orders handed over the men to secret agencies. It is pertinent to mention here that the three brothers along with Dr Niaz Ahmed, Shafiqur Rehman, Muhammad Aamir and Mazharul Haq were acquitted by an anti-terrorism court in April 2010 of the cases of firing anti-aircraft shots at the plane of former President Pervez Musharraf, of carrying out suicide blasts on the staff bus of a secret agency outside Hamza camp and on the main gate of military general headquarters.
