Former Supreme Court Bar Association (SCBA) President and Pakistan People’s Party (PPP) leader Senator Aitezaz Ahsan said fair trial is the fundamental right under Article-10A, which should be assured.

Talking to media at his residence before leaving for the apex court, Ahsan asserted that his viewpoint in the contempt case should be accepted, emphasizing that as many as five judges do not deserve to sit in the bench as according to Article-10A, a judge or an authority who has issued a show-cause notice, cannot sit in the bench hearing a concerning petition.

Authority who frames charge-sheet, is not eligible to hear the same case, Ahsan added.

‘My objection is legal and technical one. And, this stance of mine is correct to the best of my reckoning. Now, this is up to the court to decide on it,’ the PM’s counsel said adding Article-10A was put in effect on April 10, 2010.

The countries, the PM’s counsel noted, do not surrender to the other countries their common citizens even like Raymond Davis, adding, ‘We will first cross River Ravi and will look to Chenab, afterwards.’

The one who killed 18 civilians in Afghanistan was taken back by the government of his country, he said.

Aitezaz Ahsan maintained as long as President Asif Ali Zardari is in his office, he will enjoy the immunity in all courts of the world.

Replying to a question, Aitezaz said the corruption should be overcome; however, if no lawsuit is filed on it, so it does not concern him.
