ISLAMABAD The Supreme Court on Tuesday again expressed grave concern over non-implementation of 16th December, 2009 judgement in letter and spirit for reopening Swiss cases against NRO beneficiaries including President Asif Ali Zardari. A three-member bench of the apex court comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Tariq Pervez and Justice Ghulam Rabbani was hearing a case against non-implementation of its order of December 16, 2009, declaring National Reconciliation Ordinance (NRO) as ultra vires of the Constitution. Justice Iftikhar reprimanding the Secretary Law asked him, Why do you want an unpleasant situation? He added they have to ensure that the judgements of the apex court are being implemented in letter and spirit. The CJP directed the Secretary Law to move summary to the Prime Minister for reopening of Swiss cases. Secretary Law Masood Chishti, who appeared on court order, told that he was out of his office and had no knowledge about hearing of the case. He sought time to do the needful in pursuance of orders dated June 16, 2010, and July 05, 2010. The Secretary said he wanted to consult Kamal Azfar, counsel of the Federation. You are Secretary Law and you dont need to consult anyone, the CJP told Chishti, saying, If you would not respect the court then who would respect you? Justice Tariq Pevez remarked that they were concerned why the Court verdicts were not being implemented in letter and spirit yet and why summary regarding reopening of Swiss cases had been delayed with lame excuses. The Court directed the Secretary Law to ensure moving of summary to the Prime Minister for reopening of Swiss cases by September 24 and further directed him to submit report before the Court. The Court asked Attorney General of Pakistan Maulvi Anwarul Haq to use his good office for moving summary to the Swiss authorities. The AG informed that the Federation had filed a review petition on NRO therefore, we must be given some time in this case. During the course of the hearing, Deputy Prosecutor General Raja Aamir Abbas while appearing before the Court lodged a complaint and stated that the Acting Chairman NAB Qazi Javed Zia deprived him of all the record of Adnan Khawaja therefore he could not appear before the Court in that case. At this the Chef Justice expressed annoyance and said that as to whom gave the permission to Acting Chairman NAB to do so. The Chief Justice observed that Acting Chairman NAB Qazi Javed Zia was performing illegally and he should be summoned to the Court. It is pertinent to mention here that a five-member larger bench of the apex court headed by Justice Nasir ul Mulk on June 11, had directed Ministry of Law to draft a new summary for opening the money laundering and Swiss cases after expressing dissatisfaction over the report submitted by the Law Ministry. The case was adjourned till September 24, 2010.
