LAHORE - An election tribunal of the Lahore High Court on Thursday declared ineligible two PPP candidates for contesting by-election on the ground that their degrees were bogus. One of them Nazeer Jutt is candidate for NA-167 and other is Allah Wasaya for PP-259. Tribunal comprising Justice Nasir Saeed Sheikh, Justice Syed Mansoor Ali Shah and Justice Muhammad Anwar-ul-Haq disqualified them after hearing arguments from both sides. In 2008 election, Nazeer Jutt was elected MNA from NA-167 and Allah Wasaya MPA from PP-259. Later when their eligibility was challenged in the Supreme Court, they tendered resignations, expecting that SC verdict would not favour them. In the bye-polls, the returning officers (ROs) had accepted nomination papers of Nazeer Jut and Allah Wasaya but the rival candidates challenged their candidatures on the plea that they had bogus degrees. Petitioner Sajid Mehdi contended in his plea that as Nazeer tendered resignation from NA seat over having fake degree, therefore he did not fulfil the conditions under Article 62-F of the Constitution. The second plea was filed by Makhdoom Basit, arguing that Allah Wasaya be declared ineligible for submitting fake degree to the Election Commission. Declaring both of them disqualified, the LHC tribunal observed that the candidates had tendered resignation for possessing fake degrees before the SCs expected verdict so that they cannot be allowed to contest by-polls.
