LAHORE-A Division Bench of the Lahore High Court on Monday allowed dance performances in stage dramas with the observation that the Punjab govt would be free to take steps to stop vulgar and provocative dance performances. The Bench comprising Mr Justice Sh. Azmat Saeed and Mr Justice Sayed Asghar Haider ruled this while disposing of an Intra Court Appeal challenging the decision of single bench wherein complete ban was imposed on dance performances. The bench also ruled that 'situational and sequential' dances would be allowed subject to observations of Scrutiny Committee and Censor Release Panel. It is pertinent to mention here that the bench had already suspended the single bench order. Advocate General Khawaja Haris submitted on behalf of the govt that the Punjab govt partially favoured the judgment of the single bench wherein it banned dances. He said that the govt favoured the part of the judgment wherein it had banned obscene dances and it did not support that part of the judgment that completely banned dances on stage. The court, however, made it clear that the Scrutiny Committee and Censor panel would not use his authority arbitrarily and would censor the scripts on merit. The ICA was filed by a drama Producer Zaheer Hussain Adil assailing order of the single bench. The Appellant also challenged the act of Punjab Council of Arts of not allowing the script of petitioner's stage drama with songs and dances. The petitioner submitted that Nov 12 judgment of the single bench, wherein it banned stage dances, was in conflict with the earlier judgments of High Court passed in 2005 that clearly stated that songs and dances in theatrical performances may not be banned outrightly. He cited three judgments of the single benches and also three of division benches wherein the courts granted permission of dances. He prayed to the court to set aside the order of single bench.
