RAWALPINDI A Division Bench (DB) of Lahore High Court (LHC) Rawalpindi Tuesday dismissed an Intra Court Appeal (ICA) filed by the federal government challenging the August 28 order of the court that removed all restrictions on the movement of Dr A Q Khan. The DB comprising Justice Nasir Saeed Sheikh and Justice Khawaja Imtiaz Ahmad dismissed the ICA saying that it is not maintainable since ICA could be moved only against the final verdict. Earlier, the government had challenged the August 28 order of Justice Ijaz Ahmed Chaudhry that removed all restrictions on the movement of Dr A Q Khan saying the decision was taken without hearing the government and without considering the February 6 decision of the IHC that was based on a mutual agreement about the movement of the scientist. Later on September 2 this year a division bench comprising Justice Mian Saqib Nisar and Justice M Khalid Alvi suspended the earlier order of the LHC removing the restrictions on Dr Khan.
