LAHORE – Postings on deputation in the Federal Investigation Agency in violation of its rules and regulations have forced the agency director general to raise voice for justice. Despite court hearings, postings on deputation of close relatives of prominent personalities have kept mum many those directly concerned with the matter. And why it should not be so; when these officers have had links with important government functionaries and ministers. In his January 7 letter to Interior Secretary Khawaja Siddiq Akbar, FIA Director General Muhammad Anwar Virk stated, “A growing tendency to maneuver the postings in the FIA on deputation by officers of different departments has been witnessed over the period, despite the fact that deputation is not a formal method of appointment. To illustrate, 64 officers (BS-17 to BS-20) are presently working on deputation basis in the FIA. All these officers got posted on deputation with prior approval of the Ministry of Interior.”According to Act 12 of FIA (APT) Rules 1975, the officers belonging to six groups, namely Investigation, Accounts, Custom, Income Tax, Engineering and Legal, having relevant experience/expertise are only entitled to be taken in the FIA on deputation against the vacancies reserved for direct recruitment and that too on the recommendations of the Departmental Selection Committee as provided in the rules. The FIA chief added, “A number of officers and even contractual employees from departments having no relevance with the functions of the FIA have stormed into the agency without due regard to requisite procedural formalities/rules. Most of these deputations even lack the requisite experience/length of service laid down in the recruitments rules. Their subsequent postings against staff or operational assignments tend to create administrative problems and resentment amongst senior officers of the FIA who deem it an infringement upon their rights and ultimately take up legal battle to oust them or stop their intake into the department.” It may be mentioned here that not only have FIA officials contacted the Islamabad High Court over the issue, but also the Supreme Court has called a report on it. “It is requested to kindly check and discourage the growing tendency of posting officers from unconcerned departments to the FIA without observing procedural requirements. Besides, the cases of the officers already working on deputation in the FIA, who do not fulfill the set criteria, also need to be reconsidered,” the letter addressed to the interior secretary detailed. Sources in the FIA revealed that over 400 individuals were posted on deputation in the FIA, and services of many of them had been terminated. These included postings from constable to additional director, they added. The sources further said that of these 400 individuals got posted on deputation in the FIA from different departments, including the PIA, EOBI, NADRA, Evacuee Trust Property Board, Khyber Pakhtunkhwa Secretariat, Sindh Assembly Secretariat, Information and Broadcasting Department, Customs, Income Tax, National Bank of Pakistan and Sales Tax Department. On March 2 last year, the Sindh High Court ruled that more postings on deputation in the FIA should not be carried out. However, this order too vanished into thin air. The sources said that if the list of such postings was critically reviewed, many secrets will unmask. One instance of posting on deputation basis is that of PTV Managing Director Yousaf Beg Mirza’s son. He was deputed from the Contecna to the FIA as assistant director on August 27, 2012. Other such cases include the postings of Federal Shariah Court Chief Justice Agha Rafiq’s son Agha Fahad as FIA Corporate Crime Circle assistant director, MPA Nabeel Gabol’s daughter Mehreen Gabol as FIA Commercial Bank Circle assistant director. Prior to their postings, the two were working for the PIA and NADRA, respectively, on contract. Also, a PPP MPA Ramesh Lal’s son Vikas was posted as FIA Immigration assistant director on deputation. Earlier, Vikas was working on contract for the NADRA. Meanwhile, sources in the Interior Ministry revealed that the matter of postings on deputation was beyond the reach of officials of the ministry. PML-Functional MNA Faqir Jadim Mangrio’s son Asghar Ali, EOBI official Khursheed Shah’s son Yazim Ali Shah, Senator Nazir Mengal’s son Hamoodur Rehman Mengal are among others who received lucrative positions on deputation in the FIA. It may be mentioned here that Nasirullah Khan Gondal who led the joint investigation team in the Arsalan Iftikhar case earlier served as sub-inspector in the Punjab Police. At present he is working as deputy director (BS-18) with the FIA.
