Eunuchs entitled to inherit property

ISLAMABAD - The Supreme Court Tuesday observed that the rights of eunuchs to life, property and dignity are also protected in 1973 Constitution therefore there should be no discrimination with them and all the government functionaries at federal and provincial levels are bound not only to provide them protection, but also to recognise their rights. The court ordered the Federal Social Welfare Department to implement the apex court orders of August 7, 2009 and 23rd December 2009 and also despatch its copies to provincial social welfare departments and chief commissioner Islamabad for implementation in the provinces as well and directed to files compliance reports. The representative of eunuchs Almas Boby has been directed to nominate one or more focal persons for interaction with the administration. The authorities have been directed to locate the parents of eunuch as they also have rights of inheritance in moveable and immoveaable assets of their parents. CJ Iftikhar Mohammad Chaudhry heading a two-member bench said that parents should not disown their children due to biological disorder. The court observed that the cases should be registered against those parents who had disown their children due to their biological disorder and efforts should be made to trace their parents. Aslam Khakki, petitioner, eulogising the cooperation of NADRA chairman and deputy chairman regarding issuance of identity cards to eunuchs, said in many case still there was problems due to their parentage issue.
